By accessing, installing, downloading, or utilizing any of our Services in any manner, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using our hosted Services and must discontinue use immediately.

You are entirely responsible for safeguarding the password and API keys that you use to access the Services and for any activities or actions under your account. InstantAI Labs cannot and will not be liable for any loss or damage arising from your failure to comply with the above. The Services and their original proprietary content, features, and functionality (excluding user-provided data and open-source components) are and will remain the exclusive property of InstantAI Labs and its licensors. Our trademarks, trade dress, and service marks may not be used in connection with any product or service without the prior written consent of InstantAI Labs.
Your Data: We claim no intellectual property rights over the data, models, schemas, or material you process using our frameworks or hosted services. Your data remains yours. By using our hosted services, you grant us a limited, worldwide, non-exclusive, royalty-free license to transmit, process, and temporarily store your data solely as necessary to provide the Services to you.
By default, our frameworks may collect anonymous system telemetry (such as error rates, execution times, and configuration types) to assist us in diagnosing issues and improving the software ecosystem. This telemetry does not contain personal data or proprietary business logic. You may opt out of this telemetry collection at any time by following the instructions provided in the framework documentation.
We strive to ensure our hosted Services are available continuously. However, we do not guarantee that the Services will function without interruption or errors. We reserve the right to perform scheduled maintenance, apply patches, or make architectural upgrades, which may result in temporary downtime.
We reserve the right at any time to modify or discontinue, temporarily or permanently, the hosted Services (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Services.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. INSTANTAI LABS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
IN NO EVENT SHALL INSTANTAI LABS, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
You agree to defend, indemnify, and hold harmless InstantAI Labs and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Services, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Services.
We may terminate or suspend your account and bar access to the hosted Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Services. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws applicable in our primary jurisdiction of operation, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
